Welcome to RIVON!
The terms “we”, “us” and “our” refer to RIVON. RIVON operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). RIVON is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully, as they contain important information regarding your legal rights and obligations.
By visiting, interacting with, purchasing from or otherwise using our Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree with these Terms, you should not use the Services.
Nothing in these Terms is intended to exclude, restrict or waive any mandatory consumer rights available to you under applicable law.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you.

Nothing in this section limits any statutory warranty, conformity requirement or other mandatory consumer right applicable to your purchase.
SECTION 3 – ORDERS
When you submit an order, you are making an offer to purchase the selected products.
After receiving your order, we may send an acknowledgement confirming receipt. An order becomes binding when it is accepted by RIVON in accordance with the checkout and order-confirmation process.
We reserve the right to refuse or cancel an order where reasonably justified, including in cases of suspected fraud, payment failure, product unavailability, obvious pricing errors or incorrect product information.
If payment has already been collected for an order that we subsequently cancel, the applicable amount will be refunded.
Please review your order carefully before submitting it.
Your rights regarding cancellations, returns and refunds are governed by our Refund Policy and any mandatory consumer protection laws applicable to you.
Products purchased through our consumer store are intended primarily for personal or household use unless otherwise agreed.
SECTION 4 – PRICES AND BILLING
Product prices, promotions and discounts may change from time to time. The applicable price will generally be the price displayed when you place your order, subject to correction of obvious errors as permitted by law.
Applicable shipping costs, taxes and other charges, where relevant, will be displayed or communicated as required before completion of the purchase.
For customers in jurisdictions where consumer-facing prices must include applicable taxes, prices will be displayed in accordance with those requirements.
Customs duties, import taxes or other charges may apply depending on the destination and fulfillment arrangement. Where such charges are not included in the purchase price, this will be handled in accordance with our Shipping Policy and applicable law.
You agree to provide accurate and current billing and payment information.
SECTION 5 – SHIPPING AND DELIVERY
Orders are processed and delivered according to the estimated timeframes described in our Shipping Policy.
Delivery times are estimates and may be affected by customs procedures, carrier delays, local holidays, weather conditions, high-demand periods or circumstances outside our reasonable control.
We will remain responsible for delivery and risk of loss to the extent required by applicable consumer protection law.
For consumers in jurisdictions where the seller bears the risk until the consumer, or a person designated by the consumer, physically receives the goods, nothing in these Terms transfers that risk earlier.

SECTION 6 – INTELLECTUAL PROPERTY
The Services and their contents, including trademarks, trade names, logos, text, graphics, photographs, videos, designs and other materials, are owned by or licensed to RIVON or their respective rights holders and are protected by applicable intellectual property laws.
You may use the Services for lawful personal and non-commercial purposes.
Except where permitted by law, you may not reproduce, distribute, modify, republish, commercially exploit or otherwise use protected content from the Services without prior authorization from the applicable rights holder.
Nothing in these Terms grants you ownership of any intellectual property belonging to RIVON, Shopify or any third party.
Shopify and its associated trademarks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to tools, applications or services supplied by third parties.
Third-party tools may be subject to their own terms, privacy policies and conditions. Where applicable, you should review those terms before using the relevant service.
We do not control third-party tools and are not responsible for their operation except to the extent responsibility cannot lawfully be excluded.
We may introduce new tools, resources or features in the future. Unless otherwise stated, such features will form part of the Services and will be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to websites or services operated by third parties.
We do not control third-party websites and cannot guarantee their content, availability, security or privacy practices.
If you access a third-party website, its own terms and privacy policies may apply.
Nothing in this section excludes liability that cannot legally be excluded under applicable law.
Questions or disputes concerning products or services purchased directly from third parties should generally be addressed to the relevant third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
RIVON is powered by Shopify, which provides the ecommerce technology that enables us to offer the Services.
Purchases made from our store are transactions between you and RIVON, unless expressly stated otherwise.
Shopify is not the seller of RIVON products merely because Shopify provides the ecommerce infrastructure used by our store.
The relationship between Shopify, RIVON and customers is also subject to applicable law and Shopify's applicable terms and privacy practices.
Nothing in this section excludes or limits rights or liabilities that cannot lawfully be excluded or limited.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data-protection legislation.
Because our Services are hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services in order to provide and improve its services.
Information may also be processed by service providers and partners involved in areas such as payments, fulfillment, delivery, analytics, security and customer support, as further described in our Privacy Policy.

SECTION 11 – FEEDBACK
If you voluntarily submit reviews, suggestions, ideas, comments or other feedback (“Feedback”), you grant RIVON a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, adapt and display such Feedback for legitimate business purposes, including operating and improving the Services, subject to applicable law.
You represent that you have the necessary rights to submit the Feedback and that it does not unlawfully infringe the rights of another person.
We may moderate or remove Feedback where reasonably necessary, including content that is unlawful, fraudulent, abusive, defamatory or infringes intellectual property rights.
Nothing in this section affects rights that cannot legally be waived or transferred.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information within the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability.
We may correct such errors and update information where reasonably necessary.
Where an error affects an order that has already been submitted, we will handle the matter in accordance with applicable law and will not use this provision to remove mandatory consumer rights.

You may use the Services only for lawful purposes.

We may reasonably restrict automated access where necessary to protect customers, systems, security, intellectual property or the integrity of the Services.
Nothing in this section restricts automated access where such restriction would be prohibited by applicable law.

You may stop using the Services at any time.
We may suspend or terminate access to the Services where reasonably justified, including material violations of these Terms, fraudulent activity, unlawful conduct or security risks.
Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should continue after termination—including intellectual property, liability, privacy, dispute-related and payment provisions—will remain effective where applicable.
SECTION 16 – DISCLAIMER OF WARRANTIES
We aim to provide accurate and reliable Services but cannot guarantee that the website will always operate without interruption, delay or technical error.
To the maximum extent permitted by applicable law, the Services are provided subject to the warranties and conditions expressly stated by RIVON and those imposed by law.
Nothing in these Terms excludes or limits statutory guarantees, warranties, conformity rights or other consumer protections that cannot legally be excluded or limited.
SECTION 17 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, RIVON will not be liable for indirect or consequential losses that were not reasonably foreseeable or that result from circumstances outside our reasonable control.
However, nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
In particular, nothing in these Terms is intended to limit mandatory consumer rights or liability that cannot legally be excluded, including where applicable liability arising from fraud, intentional misconduct, gross negligence, personal injury or other legally protected circumstances.
SECTION 18 – INDEMNIFICATION
To the extent permitted by applicable law, you may be responsible for losses or claims resulting directly from your unlawful use of the Services, your material breach of these Terms or your infringement of third-party rights.
This section does not require a consumer to indemnify RIVON for matters for which the consumer cannot legally be held responsible.
Any indemnification obligation will apply only to the extent permitted under applicable law.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary and permitted by law.
Where appropriate, the unenforceable portion will be severed without affecting the validity and enforceability of the remaining provisions.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
Failure by RIVON to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with the policies and information expressly incorporated into them, constitute the agreement governing your use of the Services, subject to applicable mandatory law.
Nothing in this section limits statutory consumer rights or representations that cannot legally be excluded.
SECTION 21 – ASSIGNMENT
You may not transfer contractual rights or obligations under these Terms where such transfer would materially affect the agreement without any consent required by applicable law.
RIVON may transfer its rights or obligations as part of a legitimate business transaction, restructuring or transfer of operations, provided that such transfer does not unlawfully reduce mandatory consumer rights.
SECTION 22 – GOVERNING LAW
These Terms are governed by the laws applicable to RIVON's business operations, subject to mandatory consumer protection rules.
If you are a consumer residing in the European Union, European Economic Area, United Kingdom or another jurisdiction that provides mandatory consumer protections, nothing in these Terms deprives you of protections granted by the mandatory laws of your country of residence.
Any dispute will be handled by a competent court in accordance with applicable jurisdiction and consumer protection rules.

The headings used in these Terms are provided for convenience and organization only and do not limit or otherwise affect the interpretation of these Terms.
SECTION 24 – CHANGES TO TERMS OF SERVICE
We may update these Terms from time to time to reflect changes in our Services, business practices, technology or applicable legal and regulatory requirements.
The current version will be made available on our website.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes will not retroactively remove rights already acquired by consumers unless permitted by applicable law.
